Taking soil materials

Taking soil for purposes other than one's own domestic use always requires a permit in accordance with the Soil Act. The Soil Act applies to the taking of stone, gravel, sand, clay and soil for transportation or for on-site storage or processing. A permit is not required if the materials are taken for one's own normal domestic use in housing or agriculture and forestry. In this case, the use of soil must be related to construction or the maintenance of transport connections. 
The person taking the sample for domestic purposes must notify the environmental agency of the location of the sampling site and the estimated extent of the sampling when more than 500 cubic meters of soil has been or is planned to be taken from the sampling area.

Soil permits and joint permits (joint processing of soil and environmental permits) are processed by the technical committee as the environmental protection authority of the municipality of Kihniö, and the environmental inspector acts as the preparatory officer.

The information to be submitted in the permit application and the content and structure of the extraction plan are regulated in detail in the Government Decree on the Extraction of Soil Materials (926/2005).

The holder of a soil permit must report the quantity and quality of soil extracted annually (Soil Act Section 23 a) during January. The form is completed electronically. The report must also be submitted when no soil has been extracted.

Environmental permit

An environmental permit is a permit under the Environmental Protection Act, which is required by the facilities and activities specified in Annex 1 of the Environmental Protection Act and Chapter 4 of the Act.
An environmental permit application must be submitted well in advance of the planned commencement of the activity. New activities may not be started or existing activities may not be continued with substantial changes without a legally binding decision.

Environmental permits are processed by the technical committee, which is the environmental protection authority of the municipality of Kihniö, and the environmental inspector acts as the preparatory officer. Instructions for applying for a permit can be obtained from the environmental inspector.

Notification procedure

The general notification procedure under the Environmental Protection Act is a permit-like procedure that applies to certain activities that cause minor environmental impacts. The obligation to notify activities is laid down in Section 115a of the Environmental Protection Act, and the activities subject to notification are listed in Annex 4 to the Act.

The operator must notify the environmental permit authority or supervisory authority of certain one-off activities that cause environmental damage.

  • One-time activities include:
    Utilization of waste in earthworks
  • temporary noise and vibration
  • experimental activity
  • exceptional situations
  • cleaning up contaminated soil and groundwater.

Registration

Registration is a recording measure in nature. The activity can be started once it has been registered. The activities that can be registered are the activities listed in Annex 2 of the Environmental Protection Act:

  • energy production plants with a fuel capacity of less than 50 MW
  • liquid fuel distribution stations
  • asphalt stations
  • fixed concrete plants and concrete product factories
  • operations using organic solvents and dry cleaners

The activity to be registered must comply with the requirements laid down in the sector-specific regulation.
