Construction site and its location:
The construction site is a property called Virranranta, measuring approximately 2070 m2. The property code is 250-405-5-80. The construction site borders the Koskelanjoki River for approximately 42 meters.
Proposed measure and justification for the application:
A deviation is being applied for to construct a leisure building less than 30 m2 on the property. The deviation is being applied for from the current building regulations so that the nearest wall of the new building would be located 18 meters from the shoreline measured at mean high water level.
Prohibitions, restrictions and the planned situation
There is no valid coastal local plan or partial master plan in the area, so the building rights of the property are determined in accordance with the valid building regulations of the municipality of Kihniö.
No building may be constructed on a coastal zone belonging to the coastal area of a sea or water body without a local plan or a legally binding master plan that specifically provides for the use of the master plan or part thereof as the basis for granting a building permit. (Act on the Use of Areas 21.4.2023/752); Section 72)
The provisions of subsection 1 also apply to a coastal area where planning of construction and other use for the purpose of arranging a holiday settlement mainly based on the shore is necessary due to the construction expected in the area.
The provisions of subsections 1 and 2 do not apply to:
1) construction necessary for the practice of agriculture, forestry or fisheries;
2) construction for the needs of national defense or border control;
3) construction for maritime needs;
4) the construction of an outbuilding belonging to the same yard as an existing residential building; and
5) repair or minor expansion of an existing residential building.
Kihniö Municipality Building Regulations
According to the Kihniö municipality's building regulations, the building rights for a plot of less than 5000 m2 in the waterfront area are 125 m2 of so-called warm space (leisure building, sauna, barn) and 30 m2 of cold storage space and 30 m2 of roof space, as well as a 16 m2 smoke sauna (provided that the distance regulations are met).
The distance and location of buildings from the shoreline must be such that the natural beauty of the shoreline is preserved. New buildings may not be located closer than 20 meters to the shoreline at the mean water level of the body of water, with the exception of a separate sauna building, which may be built 15 meters from the shoreline.
Construction status:
There is an existing leisure building of 28m2 on the construction site.
Consulting neighbors:
The applicant has informed the neighbor. The neighbor has no objections.
Building restriction from which an exemption is sought:
The construction restriction for which a deviation is being sought is the provision in section 7.1 of the building regulations regarding the placement of buildings other than saunas closer than 20 meters from the shoreline at mid-water level.
Conditions for derogation and justification for the proposed decision:
Section 57 of the Building Act; the decision-making authority for granting a deviation permit lies with the municipality.
For a special reason, the municipality may, upon application, grant a derogation from a provision, order, prohibition or other restriction concerning construction or other measures provided for in this Act or issued pursuant to it.
However, a deviation may not be granted if it:
1) causes harm to zoning, the implementation of the plan or other organisation of the use of areas;
2) makes it difficult to achieve nature conservation objectives;
3) makes it difficult to achieve the objectives of protecting the built environment; or
4) leads to construction with significant impacts or otherwise causes significant adverse environmental or other impacts.
The applicant justifies the location of the new building closer than 20 meters from the shore by the terrain conditions of the construction site. Neighbors have not raised any objections to the project.

The technical committee decides to propose to the municipal government that the deviation be approved based on the above-mentioned reasons. The construction must be adapted to the environment and landscape.
This deviation decision must be attached to the construction permit application corresponding to the deviation permit. The deviation permit is valid for one year, during which time the construction permit must be initiated.

STATEMENT ON THE NERKOOJÄRVI BEACH STATION PLAN PROPOSAL
The Technical Committee requests a statement on the proposed plan for the Nerkoojärvi waterfront development plan.
Observations on the zoning proposal
Plan areas A-D are located on different sides of Lake Nerkoonjärvi in connection with and in the environment of existing construction sites. The plan description clearly illustrates the existing waterfront plan areas and the changes to them. The waterfront plan is mainly prepared for holiday housing, with the exception of two permanent construction sites. The planning of year-round settlement should primarily be planned through the master plan. However, it is unlikely that the municipality will launch a master plan, so using the waterfront plan as a means of increasing the number of new construction sites and building rights granted through individual deviation permits is a more systematic method and enables wider participation in the area around the plan areas. For property 250-407-9-137, locating the sauna building approximately 200 meters away from other buildings on the property is not appropriate. According to the building register, the property already has an existing sauna building.
Various observations from the planning documents; the planning regulations mention twice the building area where a sauna building may be located. In addition, the section governing wastewater treatment refers to a building permit application, the current term is a building permit.
The Technical Committee decides to approve the proposed waterfront site plan, with the above-mentioned comments corrected in the form presented in the provisions of the proposed plan.
The technical committee further proposes to the municipal board that the plan proposal be approved and that the municipal board make the plan proposal available for public viewing and request the necessary opinions on it.

The majority of the technical department's services have been transferred to electronic services, i.e. to the information network, messaging applications and telephone. In order to make the administrative work of the technical department more efficient, it is proposed that the office's opening hours be reduced from the current 5 days a week to 2 days a week. The opening days are proposed to be Wednesdays and Thursdays, because on Wednesdays it is usually possible to provide on-site customer services by the person in charge regarding environmental protection and on Thursdays regarding building supervision. Of course, dealing with the technical department will continue to be possible 24/7 via the information network and other electronic channels, regardless of schedule. On-site transactions are also possible on all working days, when they have been agreed in advance via electronic channels.
This change will make it possible to make the technical department's operations more efficient, as customer meetings can be arranged better in advance than before. The majority of the technical department's work is done in preparing matters and in the related scheduled meetings. The small number of staff in the technical office also means that an expert is typically not available during office opening hours, and at worst, the customer can only be booked for an actual meeting time after a wait.
The Technical Committee proposes to the Municipal Board that the opening hours of the Technical Department's office be centralized so that the office is open for unscheduled customer visits only on Wednesdays and Thursdays. Electronic services are available 24/7 and pre-arranged customer meetings will continue to be possible on all working days.
