§ 40 Application for derogation, exceeding building rights

A deviation application regarding the violation of building rights was submitted to the Lupapiste.fi service on November 23, 2024.

Construction site and its location:

The construction site is an existing 3000 m2 building site with property code 250-407-15-38. The construction site borders Lake Nerkoojärvi for approximately 60 meters.

Suggested action:

A deviation is being applied for in the Kirvesniemi coastal plan for exceeding the building rights of the permitted building site. The applicant wants to build a new leisure building of 100 k-m2 in place of the old one and demolish the old leisure building of 62 k-m2. The new leisure building will be located on the same site as the old leisure building, approximately 29,5 meters from the shoreline. An additional 30 m2 of roof will be built on the construction site. After the proposed measure, the total built floor area of ​​the property would be 141 m2.

Construction status:

There is an existing leisure building of 62 m2 on the construction site, which was put into use in 1985 after renovation. In addition, a sauna building of 35 m2 and a storage building of 6 m2 are under construction on the construction site.

Prohibitions, restrictions and schematic situation:

The Kirvesniemi waterfront plan is in force in the area. According to the waterfront plan regulation, one leisure building with a sauna and utility buildings of a total of 100 m2 + 30 m2 of cold storage space may be built on the site. Buildings other than the sauna must be located within the construction area indicated in the waterfront plan. The sauna building may be located at least 10 meters from the shore.

Consulting neighbors:

The neighbors have no objections to the matter. (MRL Section 133)

Justifications for the requirement for deviation:

According to Section 171 of the MRL, the municipality has the power to make exceptions.

The current built-up floor area of ​​the property is 103 m2. With the construction of the new leisure building, the built-up floor area of ​​the property would be 141 m2. The building right indicated in the coastal plan would exceed 11 m2.

The planned construction will not cause a significant change. The construction will adapt to the coastal landscape and other environments. The deviation will not cause harm to the landscape values ​​of the area or to nature and water protection. The deviation will not cause harm to zoning, the implementation of the plan or other organization of the use of areas. The deviation will also not lead to construction with a significant impact or otherwise cause significant harmful environmental or other impacts.

Proposal for a decision

The technical committee decides to propose to the municipal government that the deviation be granted and sends the decision to the municipal government for approval. The construction must comply with the provisions and regulations of the current Wastewater Decree, fire regulations and other regulations set for construction. The deviation permit decision is valid for 1 year, during which time a building permit corresponding to the deviation permit must be initiated. The deviation permit decision must be attached to the building permit application.

§ 41 Purchase of a lawnmower

The Technical Services Machine Center has been using a lawnmower, which is provided to the service provider (4H) for use under the green area maintenance agreement. The leasing period of the previous lawnmower has ended on 30 September 2024.

Bids have been invited for the purchase of a new lawnmower. The purchase will be carried out as a four-year leasing purchase. The purchase does not exceed the national threshold of the Procurement Act. The purchase will comply with the administrative regulations and procurement guidelines of the municipality of Kihniö.

Bid comparisons and a proposal for selected bidders will be presented at the meeting.

§ 42 Amendment of the administrative regulations

Municipal decision-making is based on the Municipal Act and the provisions of the municipal administrative regulations. The administrative regulations are the most central document in terms of the internal division of powers within the municipality. Section 90 of the Local Government Act provides for the content of the administrative regulations. The council decides on the content of the administrative regulations and any amendments. The municipal administration must comply with the provisions of the administrative regulations. The administrative regulations stipulate the organisation of elected officials and office holders in Kihniö Municipality, as well as the decision-making powers and responsibilities of the institutions and office holders.

Section 38 of the Administrative Regulations sets out the duties and powers of the technical committee and section 40 sets out the duties and powers of the building inspector. The amendment to the Administrative Regulations regarding the duties and powers of building supervision has become necessary due to the amendments to the Construction Act and the series of amendments to the Construction Act.

The Construction Act stipulates the duties of the municipal building control authority, e.g. building permits. The administrative regulations must specify which municipal body is the municipal building control authority. The body acting as the building control authority may, by its own decision, transfer duties and powers to an official.

The most important proposed changes to the administrative regulations are the tasks of the municipal board, technical committee and building inspector under the Construction Act.

§ 43 Planning of Sulkuejärvi

The 2025 budget has allocated an allocation of 40,000 euros for the expansion of the Kirkonkylä local plan. The aim of the expansion of the local plan is to create a new residential area to the west of Sulkuejärvi on the Rempunranta and Rempunranta I properties owned by the municipality. The area covers approximately 13 ha. It is also possible to designate the expansion of the local plan to include properties owned by private landowners as far as Kankarintie, which will provide the most optimal connection to the local plan road.

A preliminary plan for the zoning programming was prepared on 13 December 2024. Based on this, a working consultation was held with the ELY Centre on 17 December 2024. According to the preliminary plot plan, it is possible to allocate approximately 11 plots of land with private shores and approximately 14 plots of dry land with lake views to the area for single-family houses. The material prepared for the planning programming is provided as supporting material.

The net impact of the local plan project on the municipal economy is conservatively estimated to be at least neutral when the costs of zoning and municipal engineering (water and sewerage, local road, street lighting and project costs) are deducted from the income from the sale of plots. The residential area can be built in stages, which also allows the costs of infrastructure construction to be phased in as the plots are sold. However, drawing up the plan would enable significant waterfront construction and would increase the municipality's plot supply of AO plots with their own waterfront that would attract both permanent and seasonal residents.

If a waterfront site plan were prepared for the area instead of a town plan, 2-3 private waterfront construction sites could be allocated according to the preliminary dimensioning of the waterfront construction sites. The construction of the infrastructure would then be at the expense of the builder. The net impact on the municipal economy would then be approximately 100,000 - 150,000 euros.

According to Section 38 of the Kihniö Administrative Regulations, the technical committee is responsible for land use planning. According to Section 22 of the Administrative Regulations, the municipal government directs and supervises zoning and land policy. The programming of the planning project is approved by the municipal government.
