§ 27 Statement on the draft Leppäsentie waterfront development plan

Since the previous review of the planning project, changes have been made to the building rights of the plots at the request of the landowners.

Proposal for a decision

After the previous consideration of the Leppäsentie planning project, the landowners in the area have proposed additions to the building rights of the plots before the plan proposal is submitted to the municipal board for consideration and, through it, for confirmation by the council. At the previous meeting of the technical committee, the total building right for the AO plot was approved as 250 m2, and the building right for the RA plots would have been 180 m2. According to the municipality's proposal, the planning regulations have also been specified in terms of the planning regulations so that the placement of buildings is guided by verbal planning regulations specifying the meaning of the planning map in addition to the construction area. According to the new amended proposal, the total floor area of ​​the AO plot would be 250 m2, which includes one residential building, utility buildings and a possible smoke sauna of 15 m2. In addition, a separate 30 m2 sauna building + 30 m2 cold storage space and 30 m2 of roof space may be built. The maximum floor area of ​​a separate utility building can be a maximum of 60 m2. The total built floor area on an AO plot can be 310 m2. On an RA plot, one holiday home, a smoke sauna of 15 m2 and outbuildings, a total of 180 m2, may be built. In addition to these, a separate sauna building of a maximum of 30 m2 + cold storage space of 30 m2 and 30 m2 of roof may be built. The floor area of ​​a separate outbuilding may not exceed 30 m2. The total permitted floor area of ​​an RA plot is 240 m2. The maximum number of buildings on both AO and RA plots can be a maximum of 7. Buildings other than saunas must be located at least 20 meters from the shore. The distance of the sauna from the shore must be at least 15 meters.

The Technical Committee proposes to the Municipal Board that the proposed plan be approved as presented above.

§ 28 Draft partial master plan for the Myyränkankaa wind farm

The municipality of Kihniö has decided to initiate the preparation of a legally effective partial master plan for the Myyränkankaas area for wind power at its meeting on 14 February 2022, Section 27. According to the decision, the partial master plan will be prepared as a master plan in accordance with Section 77 a of the Finnish Land Use Act, which means that the master plan can be used directly as the basis for a building permit.

On 15 June 2022, the Technical Committee approved the Participation and Assessment Plan (OAS) for the Section 61 Myyränkankaas Wind Farm Sub-General Plan and decided to make it available for 30 days for soliciting opinions and statements. The OAS was available on the Kihniö Municipality website and as paper material at the municipal hall and library from 23 June to 14 August 2022.
During the initiation phase of the partial master plan, a joint public event was organized in Puumila on June 28, 2022, along with the environmental impact assessment (EIA) procedure for the Myyränkankaa wind power project.

The project area is located in the municipality of Kihniö, approximately 9 kilometers northeast of the central business district of Kihniö. The planning area is located on the border of Virtai municipality and approximately 5 kilometers from the border of Seinäjoki municipality and 7 kilometers from the border of Kurikka municipality. The nearest village is Kurjenkylä, approximately one kilometer east of the planning area. The preliminary total area of ​​the wind power project planning area is approximately 40 km2.
The planning area is mainly a forested area used for forestry. Based on the building data in the terrain database of the National Land Survey of Finland, there are no residential or holiday buildings in the planning area. The nearest settlements are located along Kurjenkylätie, approximately 1 kilometer east of the planning area, and along Isonniementie, approximately 1 kilometer west of the planning area.

Alongside the Myyränkankaas partial master plan, the environmental impact assessment procedure (EIA procedure) for the Myyränkankaas wind power project will be implemented simultaneously as a separate process. The EIA procedure will examine the environmental impacts of the project and its alternatives. The prepared reports and the results of the assessment will be utilized in the partial master plan, which will decide on the implementation of the project. The partial master plan will define, among other things, the locations, maximum numbers and heights of power plants that can be placed. The plan may also include provisions to mitigate adverse impacts.

A wind farm with a maximum of 27 windmills is planned for the entire project area, with a unit capacity of 7-10 MW per windmill. The total height of the wind turbines is a maximum of 320 meters. The partial master plan examines the maximum solution considered in the EIA procedure, which is 19 wind turbines in the Kihniö municipality's plan area.

The draft plan designates 19 wind turbine construction sites for the Kihniö planning area. The total height of each power plant is a maximum of 320 meters above ground level. The plan solution designates the area as an agricultural and forestry area, where wind turbines may be located in the designated areas (tv-1). The location of power plants in the tv-1 area is defined by an indicative circular marking, within which the wind turbine must be located. The exact location of the power plants is defined in connection with the building permit. Construction serving agriculture and forestry is permitted in the agricultural and forestry area. The plan indicates the road alignments required by the power plants, which are partly existing and partly new. New road alignments are indicated with a dotted line. The location of the underground cable serving the internal electricity transmission of the wind power area is indicated as an indicative location along the service roads. The area of ​​the plan area is 2996,46 ha. Valuable natural sites are indicated with a luo marking.

The nearest urban settlement to the wind turbines is in the village of Kihniö, approximately 5 kilometres southwest of the planning area. The central settlement of Virtai is located approximately 21 km east of the planning area. A total of 9 residential buildings and 26 holiday homes are located less than two kilometres from the nearest planned wind turbine.

The impacts of the entire project have been comprehensively assessed in the EIA report. The environmental impact assessment is based on a multi-objective assessment, i.e. a systematic examination of the magnitude of the impacts, the nature/sensitivity of the affected areas and the resulting significance of the impacts.

Land use in the planning area is mainly forestry. There are no community structure or land use development needs in the planning area or its immediate vicinity that would not be compatible with wind power construction. The planning solution does not conflict with the regional plan. With the implementation of the plan, forestry can continue in the majority of the area.

There are no nationally or provincially valuable landscape areas or areas of built cultural environment in the planning area or its immediate vicinity. The significance of the landscape impacts is assessed as varyingly minor, moderate or even significant in places, depending on the location and distance to the power plants. The viewer's experience also affects the significance.

A visual area analysis and illustrative images have been prepared to assess the landscape impacts.

Wind turbines can affect people's living conditions and comfort, especially due to noise, glare and changes in the landscape. The noise impacts of the Myyränkankaas wind power project will remain below the guideline values ​​set out in law and regulations. The most significant impacts on traffic will be caused by special transport arriving in the area during the construction of the wind turbines.

The project area does not include any Natura areas or areas under conservation programmes. The project area includes four Natura areas and two nature reserves.

The landscape and soundscape of the area will change in the vicinity of the power plants, which will have an impact on the recreational experience. The most significant impacts on game will focus on the disturbance during construction and the potential increased traffic in the area. The project will not significantly affect the hunting potential of the area, and the impacts on hunting arrangements and recreational use are assessed to be minor.

The implementation of the wind power project will have positive impacts on the climate, as the project, when implemented, will enable lower-emission electricity production.

In accordance with the Land Use and Building Act, the draft plan is made available for consultation during the preparatory phase. During the public consultation during the draft phase, stakeholders have the opportunity to express their views by submitting a written opinion. The public consultation during the draft phase is scheduled to coincide with the public consultation of the environmental impact assessment report.

Proposal for a decision

The Technical Committee approves the draft plan for the Myyränkankaas wind power sub-general plan and decides to submit it to the municipal government for approval and that the municipal government request the necessary official statements. The draft plan will be made available for viewing after the municipal government's approval decision.

In addition, the technical committee proposes that because the harmful effects of the wind farm are local, the project manager must take into account that local benefits are also optimized primarily in the planning solution as the planning process progresses.

The project manager should consider the route of the transmission line primarily in accordance with option SVE2.

§ 29 Application for exemption / holiday home

Construction site and its location:

The construction site is a 11,400 m2 property with property code 250-407-5-61. The construction site borders Lake Nerkoonjärvi by approximately 53 meters.

The property is located in an unzoned coastal area. On a plot of over 5000 m2, the building right is 150 m2 (leisure building, sauna and barn) + 30 m2 of cold storage space + 30 m2 of roof space + 16 m2 of smoke sauna (if the distances according to fire regulations are met).

MRL § 72

No building may be built on a coastal zone belonging to the coastal area of ​​a sea or body of water without a local plan or a legally binding master plan that specifically stipulates that the master plan or part of it be used as the basis for granting a building permit.

MRL § 171

For a special reason, the municipality may, upon application, grant a derogation from a provision, order, prohibition or other restriction concerning construction or other measures provided for in this Act or issued pursuant to it.

However, a deviation may not be granted if it:

1) causes harm to zoning, the implementation of the plan or other organisation of the use of areas;

2) makes it difficult to achieve nature conservation objectives;

3) makes it difficult to achieve the objectives of protecting the built environment; or

4) leads to construction with significant impacts or otherwise causes significant adverse environmental or other impacts.

Consulting neighbors:

Justifications for the requirement for deviation:

According to Section 171 of the MRL, the municipality has the power to make exceptions.

The construction site is undeveloped. The building right of the construction site has been examined through a land survey in accordance with established practice. According to the dimensioning calculation, the building right determined by the length of the land shoreline:

1190 mx 6pcs/shoreline km= 7,14 pcs. 7 of the block properties of the land plot have used the building right, but the property Kärkikulma 250-407-5-99 does not have a shoreline impact. Since the land plot has the right to 7 shoreline spaces according to the dimensioning based on the length of the shoreline, 1 building right remains for the land plot, which can be assigned to the property 250-407-5-61 Kutusaari. The property Kutusaari meets the requirements for a building site according to the Kihniö building regulations.

According to the building regulations, the building right for a plot of land over 5000 m2 located in an unzoned area is 150 m2, which includes a leisure building, sauna and barn. In addition, a cold storage room of 30 m2 and 30 m2 of roof space may be built. The minimum distance of the leisure building from the shore must be at least 20 meters.

The deviation does not cause any harm to the zoning, implementation of the plan or other organization of the use of the areas. The deviation also does not lead to significant construction or otherwise cause significant harmful environmental or other impacts.

Construction must be adapted to the coastal landscape and other surroundings.

§ 30 Application for derogation / change of purpose of use

Construction site and its location:

The construction site is a property called Hattuvatti, which is approximately 0,33 hectares in size. The property ID is 250-407-8-146. The construction site borders Lake Nerkoo for approximately 64 meters.

Proposed measure and justification for the application:

A deviation is being applied for to convert a 119 m2 recreational building into a permanent residential building. In addition, the property has a 12 m2 sauna and a 14 m2 utility building. The building was renovated in 2012 to meet the requirements of a residential building.

Prohibitions, restrictions and the planned situation

The Niemiranta waterfront zoning plan is in force in the area.

According to the coastal plan marking RA, the area is intended as a holiday building site, where one holiday home and the necessary sauna and utility buildings may be built. The total floor area of ​​these may not exceed 120 m2.

Construction status:

There is an existing leisure building on the construction site with a floor area of ​​119 m2. In addition, there are 2 outbuildings on the construction site, a sauna of 12 m2 and an outbuilding of 14 m2. No changes will be made to the buildings.

Consulting neighbors:

The applicant has consulted the neighbors. No comments.

Building restriction from which an exemption is sought:

The Niemiranta coastal site plan is in force in the area. The construction site has been designated as a holiday construction site with an RA marking. The coastal site plan provisions on the amount of building rights for a coastal construction site state that the maximum permitted amount of building rights is 120 m2. This includes a leisure building and necessary outbuildings. Construction restrictions for which an exemption is sought in the application are deviation from the provisions of the coastal site plan and MRL § 72; no building may be built in a coastal zone belonging to the coastal area of ​​a sea or body of water without a site plan or a legally binding master plan that specifically stipulates the use of the master plan or part of it as the basis for granting a building permit.

Conditions for derogation and justification for the proposed decision:

MRL Section 171; the decision-making power to grant an exemption lies with the municipality.

The building in question meets the requirements of a permanent residential building. The property is accessible by a road that is passable all year round. There are 4 other permanent residential buildings within a distance of approximately 1 km. The neighbors have no objections to the project. The building is equipped with pressurized water and the wastewater drainage has been implemented in accordance with the provisions of the current Wastewater Decree.

§ 32 Rent review of the renovated apartment of As Oy Ohtolanpää

Due to the renovation of one of the apartments at Asunto Oy Ohtolanpää, the rental price must be re-determined in order to cover the renovation costs. The apartment's bathroom and saunas, as well as the kitchen and furniture, have been completely renovated, the surfaces have been painted and the floors have been renewed. The renovation costs are approx. 596 €/m2. The current rental level is 6,74 €/m2.
