§ 92 Amendment of the administrative regulations

The municipal administrative regulations are being amended due to changes in legislation and organization. According to Section 14 of the Local Government Act, the municipal council decides on the municipal administrative regulations.
Regarding the tasks and powers of building supervision, a change in the administrative regulations has become necessary due to the amendments to the Construction Act and the series of amendments to the Construction Act.

Due to changes in the duties of the administration department in general administration, the duties of the financial and administrative director/mayor will be changed and the title in question will be removed from the administrative regulations.

§ 93 Municipal initiative "It is time for the municipality of Kihniö to reform its organization right now"

A municipal initiative has been received in the municipality:

The new council will begin its four-year term at the beginning of June. At the same time, the position of technical director is vacant in Kihniö. Earlier this year, the positions of financial and administrative director and mayor were combined.

Now would be an excellent opportunity to organize the administration of the municipality of Kihniö even more thoroughly. I propose the following changes:

The Technical Committee and the Welfare and Education Committee will be abolished. In their place, two divisions will be established for the municipal government, which will handle those official tasks that the municipal government is not allowed to handle by law, as well as other tasks prescribed by administrative regulations: the Education and Culture Division and the Technical Division.

The position of technical director will be abolished, replaced by a manager-level position. The title of office engineer will be changed, for example, to municipal engineer, who will act as the technical section's rapporteur, replacing the previous technical director.

Educational and cultural activities will continue under the supervision of the Director of Welfare. In matters related to basic education, the principal acts as the rapporteur, in other matters the Director of Welfare.

A new division will be established to develop early childhood education. The function will continue under the supervision of the Director of Welfare. The director of the daycare center will serve as the rapporteur for the early childhood education division.

Employment matters would be assigned to the Vitality Division.

After the change, 5 divisions would operate under the Municipal Government:

-education and culture division

-Early Childhood Education Division

-technical division

-vitality division

-personnel department

Other divisions would be established as necessary by administrative regulation.

After the change, the municipal management team would include the mayor, the welfare director, the principal, the municipal engineer, and the financial manager.

Reasoning:

The current organizational structure is a throwback to the time when health and social services were the municipality's most important sector and tax revenues tripled. Now it is education and culture, and, as a new feature, employment matters. The new structure could reduce the number of positions. Carrying out the tasks would require correspondingly increasing service purchases in tasks requiring special expertise.

I propose that these changes be made by decision of the current council, so that the new council's positions of trust can be filled from the beginning according to the new model. There is time for this, but we must act quickly.

In this context, I would like to especially thank the outgoing Technical Director for his excellent work.

However, when a technical director moves on to more demanding tasks in his career, a successor can now be selected with a new profile and some of the tasks can be subcontracted.

§ 94 Appointment of a representative and deputy representative to the joint meeting of the Sasky and Sataedu education associations

In accordance with Section 60 of the Local Government Act 410/2015, representatives to the association meeting are elected as follows:

The representative to the association meeting is elected separately for each meeting by the municipal board of the member municipality or another municipal body decided by the council of the member municipality.

The Sataedu joint meeting will be held on May 30, 2024 at 2:00 PM at the Sataedu Ulvila office.

Sasky's association meeting will be held on June 11, 2024 at 4 p.m. in the auditorium of Vammala Vocational School.

The names and email addresses of representatives and alternate representatives are requested to be submitted to the joint municipal registry office at kirjaamo@sasky.fi by May 24, 2024. Sataedu representatives at sataedu@sataedu.fi by May 27, 2025.

The municipal government will appoint a representative and deputy representative to the joint meeting of the Sataedu and Sasky educational joint municipalities.

§ 95 Additional appropriation; Geopark cross-country trail Aitoneva-Käskyvuori
Proposal for a decision

The municipal government proposes to the municipal council that an additional allocation of 15.000 euros be granted in the 2025 budget for investments at the Geopark cross-country trail Aitoneva-Käskyvuori cost location for the installation costs of route signs.

§ 96 Legality and enforcement of municipal council decisions

According to Section 39 of the Local Government Act, the municipal government is responsible for, among other things, the preparation, implementation and supervision of the legality of the council's decisions. If the municipal government considers that the council's decision has been made in an incorrect order or that the council has exceeded its authority or that the decision is otherwise unlawful, the municipal government must not implement the decision. In such a case, the matter must be brought before the municipal council again without delay. (Section 96 of the Local Government Act)

§ 97 2024 audit report, audit minutes and evaluation report

On May 21, 2024, the Audit Board issued the audit report, assessment report, and audit report on the 2023 financial statements.

The Audit Committee has assessed the objectives of the administrative units and their achievement. According to the Audit Committee's understanding, the operations of the administrative units have been in all material respects in accordance with the objectives decided by the council. However, the evaluation report has presented questions to the administrative units, to which the committees must provide answers so that they can be considered by the municipal government at the September meeting on 16 September 2024. The Audit Committee requests that the municipal government issue a statement in accordance with Section 121.5 of the Local Government Act by the end of September.

The municipal council will discuss the financial statements at its meeting on May 26, 2025.

Attached is the audit report, evaluation report and auditor's report, Appendix 3.

The municipal government notes the audit report, the audit report and the evaluation report as brought to its attention and requests the boards to respond to the questions and comments posed to them by the municipal government in the evaluation report so that the answers can be provided to the council by the end of September.

§ 98 Request for rectification regarding the election of the technical director

At its meeting on April 28, 2025, the Municipal Board has elected Reijo Väliharju, Master of Science (Engineering) in Civil Engineering, to the position of Technical Director under Section 87.

Municipal member XX has filed a claim for rectification on May 8, 2025.

I demand that the decision be overturned and the matter returned for preparation.

Reasoning:

1) Kihniö Municipality does not need a technical director, the actual job description is at the manager level, where one's own work is emphasized. In reality, the position only has 2 subordinates to whom tasks can be delegated. Otherwise, it is about management and procurement.

2) A municipal initiative was submitted on 4.4.25, which has not been taken into consideration ( https://www.kuntalaisaloite.fi/fi/aloite/42751 ). The initiative proposes changing the position of technical director to municipal engineer. The election has been unnecessarily rushed, which has made the initiative meaningless. The municipal government should have considered the initiative before the election.

3) According to the documents, the most suitable candidate for the position is Annaleena Rytkönen, a civil engineer (BA), whose work experience fully meets the real needs of the municipality of Kihniö and the requirements presented in the job advertisement approved by the municipal board. In second place is Tapio Laakkonen, M.Sc. (Econ.). Reijo Väliharju, who was selected for the position, is overqualified and has worked in positions where subordinates have done the work, which is not possible in Kihniö.

4) The best-suited person may have been overlooked based on gender, in which case the presumption of discrimination applies.

The person making the request for rectification is demanding that the official selection decision be annulled and returned to preparation.


Proposal for a decision

The municipal government considers the appellant's claims for the annulment of the technical director's selection decision to be unfounded and rejects the appellant's claim for rectification in its entirety. The grounds for rejecting the claim for rectification are as follows:

1. The opinion expressed in point 1 of the claim for rectification regarding the organizational structure is the person's own and has no legal significance with regard to the selection decision. The administrative regulations approved by the Kihniö municipal council contain the duties and position of the technical director and the municipal board, whose competence includes the selection of the technical director. The municipal board has made a decision on the application process for the technical director and filling the position.

2. The municipal initiative does not bind the municipal government's authority. The filling of the position was expedited so that sufficient resources to secure operations could be made available as soon as possible. The municipality follows the current administrative regulations, which include the position of technical director.

3. The selection was based on an overall assessment, which took into account the eligibility criteria, education, work experience, interview and general civil servant appointment criteria, which are skills, abilities and proven civic virtue. All of these elements were considered to be best met by the selected person. The educational requirement must be a Master of Science in Engineering. The educational requirement is also met by all those invited to the interview. Long work experience in responsible positions has been considered an advantage for the selected person over the other interviewees. The selected person has experience in the municipality, the other interviewees did not. This was considered an advantage, as mentioned in the application notice. The interview clearly demonstrated the extensive experience of the selected person, which is required for the position of technical director.

The appellant himself has stated that the applicant is "overqualified" for the position.

4. When filling the position, the provisions of the Equality Act and the prohibition of discrimination in Section 12 of the Act on Employment Security for Municipal Officials Act were taken into account. There were a total of 16 applicants, of whom three were women, or 18,75%. One woman and three men were selected for the interview, making the proportion of women invited to the interview 25%, or slightly more than the proportion of applicants. The selection was not made on the basis of an assessment of the person's gender, but, as mentioned above, on the basis of an overall assessment.

§ 99 Election of the acting technical director

The Kihniö municipal board elected Reijo Väliharju, M.Sc. (Eng.), to the position of technical director. A claim for rectification has been filed against the election. Due to the claim for rectification, the position of technical director must be filled on an acting basis until the municipality's claim for rectification has expired and the election can be declared legally valid.

According to the administrative regulations, the selection of the technical director is the responsibility of the municipal government.

Section 100 Tax revenue forecast for 2025

According to the tax revenue forecast received from the Association of Local and Regional Authorities, tax revenue in Kihniö will be approximately 53.000 euros less than budgeted this year and approximately 77.200 euros more than in 2024.

The current year's budget was approved with a surplus of 25.474 euros. Municipal tax revenue in 2024 was 2.517.543 euros and according to the forecast, municipal tax revenue at the end of 2025 would be 2.636.000 euros (difference + 118.457).

Corporate tax revenue in 2024 was 643.862 euros and according to the forecast, corporate tax revenue at the end of 2025 would be 605.000 euros (difference -38.862).

The property tax revenue in 2024 was 598.388 euros and based on the forecast, the property tax revenue would be 596.000 euros (difference -2.388) at the end of 2025.

The agenda includes the Association of Local and Regional Authorities' estimate (5/2025) of the municipality's tax revenue collection for 2025 (attachment), according to which the total tax revenue of the municipality of Kihniö in 2025 would be 3.837.000 euros (3.759.795 / 2024).

§ 101 Recipients and approvers of purchase invoices

According to the municipal administrative regulations, the municipal government is responsible for organizing internal control and risk management. In accordance with the budget implementation guidelines, the auditors/recipients of invoices are checked annually.

The municipality uses an electronic invoice approval procedure. To ensure internal control, the recipient and approver of invoices must not be the same person. One's own invoices cannot be approved, and as a rule, a subordinate cannot approve a supervisor's invoices. Invoice recipients/auditors check the accuracy of the invoice. The recipient must check the information with the person ordering the goods or services. The approver of invoices must ensure that the invoice contains appropriate account entries and other invoicing information. The person ordering the goods or services is responsible for complaints. Invoices must be submitted for payment immediately after approval to avoid late payment interest.

When the actual recipients of invoices are unable to attend, the department head receives the invoices and the mayor or finance manager approves them.

§ 102 Information matters of the municipal leader

§ 103 Real estate transfer notifications

According to Section 1 of the Pre-emption Act (5.8.1977/608), a municipality has a right of pre-emption in the sale of real estate located in the municipality in order to acquire land for community development and for recreational and conservation purposes. The right of pre-emption means the municipality's right to redeem the sold real estate for the purchase price agreed upon by the seller and the buyer. When using the pre-emption, the municipality takes the place of the buyer and acquires ownership of the area that is the subject of the sale under the terms of the deed of sale.

The municipality must also compensate the buyer for direct costs related to the transaction and pay interest on the costs in accordance with Section 3, Paragraph 2 of the Interest Act (633/1982). According to Section 21 of the Pre-emption Act, the municipal government decides on the exercise of the pre-emption right. The decision must be made and the registration authority, i.e. the Land Survey, notified of it within three months of the certification of the transfer deed.

The decision must be given without delay as a demonstrable notification to the buyer and seller.

§ 107 Municipal website acquisition

The current editor of the Kihniö municipality website has announced that the development of the site will not be continued in its current form, so a new editor must be found for the website.

The municipality opened a market dialogue on the renewal and maintenance of the municipality's website by 14 March 2025. Three suppliers registered for the dialogue, with whom discussions were held and the implementations were reviewed. Bids had to be submitted by 8 May 2025 at 12 noon. Three suppliers submitted bids: Zenda Oy, Tietotalo Infocenter Oy and Oy Poutapilvi web design Ab.

The bids were evaluated in three stages:

1. Tenderer eligibility

The purpose of the first stage of the evaluation and selection process is to determine the bidder's ability to provide the services in accordance with the eligibility requirements set out in the call for tenders. At this stage, the bidder's information in accordance with the Customer Liability Act was checked. All bidders met the conditions.

Requirements relating to technical capacity and professional competence. The tenderer must meet the requirements relating to capacity and professional competence sufficient for the procurement. All tenderers met the conditions.

2. Compliance with the request for tender

In the second stage of the evaluation and selection process, the offers of the tenderers who passed the first stage are evaluated. The offers are checked against the requirements that are required for the services to be purchased.

If the offer contains terms that deviate from the invitation to tender, the offer must be excluded from the tender competition.

Zenda Oy does not meet the minimum conditions set for the offer regarding the validity of the offer (the offer is valid for 30 days). The project stages “Design and establishment of a new intranet site (possible integration into the protocol system)” have been offered by Zenda Oy as an option in its offer, although the service must meet this requirement. Therefore, Zenda Oy is excluded from the tender.

3.Comparison of offers

The basis for comparing offers is the lowest price.

The price includes the entire package and operating costs for 5 years according to the request for quotation. The cheapest offer was Tietotalo Infocenter Oy's offer of 36.360 euros, with the option of purchasing, among other things, a language translation program. An investment budget of 30.000 euros has been reserved for the current year to update the website and the minutes program. This year's costs are website (5 months of usage fees) + website 16.890 euros.
