§ 75 Selection of the minutes inspectors
Proposal for a decision

Two minutes reviewers will be elected. In accordance with the agreed practice, the reviewers will be Kirsi Jytilä and Nina Niemenmaa. The minutes will be reviewed on April 28.4 and will be available for viewing on the municipality's information network.

§ 76 Planning of Sulkuejärvi

40.000 euros have been allocated for zoning in the current year's budget. At this stage, no investment money has been allocated for the development of the area for the planning years.

The technical director will present the matter at the meeting.

The municipal government decides that the deviation will be approved in accordance with the proposal of the technical committee. The construction must comply with the provisions and regulations of the current Wastewater Decree, fire regulations and other regulations set for construction. The deviation permit decision is valid for 1 year, during which time a building permit corresponding to the deviation permit must be initiated. The deviation permit decision must be attached to the building permit application.

§ 78 Approval of the management contract

At its meeting on 14 April 2025, Section 4 of the Kihniö Municipal Council decided to elect Acting Mayor Kristiina Mäkelä, Master of Public Administration, to the position of Mayor of Kihniö for the time being.

According to Section 42 of the Local Government Act, the municipality and the mayor must conclude a manager's agreement, which sets out the conditions for managing the municipality. The manager's agreement is approved by the municipal government. The purpose is to clarify the division of labour between the political leadership and the mayor and to agree on common rules of the game. The agreement usually includes matters relating to the conditions for performing the task, the evaluation of the work and the resolution of potential conflicts. The content of the manager's agreement is only regulated in general terms in the law, so that the municipalities can consider the content of the agreement themselves. The law also does not stipulate a deadline by which a management contract must be concluded upon taking up the position. However, it is justified that the preparation of the management contract begins already during the recruitment phase and the contract is approved when the employment relationship begins.

The approval of the management contract is discussed on the proposal of the chairman of the municipal board.

§ 79 Procurement of multifunction devices

The municipality's multifunction devices' leasing period is ending in early autumn. There are a total of five devices in different units. The municipality is participating in Hansel's joint procurement of multifunction devices. The framework agreement allows for so-called mini-competitions among the bidders involved in the procurement agreement. A request for tender was sent to three suppliers for five devices, with different print speeds, an estimate of the annual number of copies and the possibility of secure printing. The selection criterion is the lowest price. We are also participating in Hansel's joint procurement for leasing services. The supplier of leasing services is CHG-Meridian. The machines are intended to be purchased under a 48-month leasing agreement.

The bids were submitted by Konica Minolta Business Solutions Finland Oy, Canon Oy and Tosihiba Tec Nordic Ab. Canon Oy had the cheapest bid.

Section 80 Statement on request for clarification

Municipal official xx has previously filed a complaint with the Regional State Administrative Agency for Western and Central Finland regarding the failure to publish the 2025 budget proposal on the municipality's website as an appendix to the agenda of the municipal board meeting on 2 December 2024. The Regional State Administrative Agency has issued a decision on the complaint on 9 January 2025 (LSSAVI/23632/2024). The decision has been sent to the Director of Finance and Administration of Kihniö Municipality for information.

The Regional State Administrative Agency for Western and Central Finland has received XX new administrative complaint regarding the same matter on 10 January 2025. According to the new complaint, the budget proposal has not been published on the municipality's website, nor as an appendix to the minutes of the municipal board meeting. The budget proposal has only been published as an appendix to the agenda of the municipal council meeting on 9 December 2024 on 5 December 2024.

An explanation is requested regarding the issues raised by the complainant in his/her writing, in particular the following:

  • Has the budget proposal been published as an appendix to the minutes of the municipal government meeting? If not, why not?
    • When will the municipal budget proposal be made public?
    • Has the complainant made a request for documents regarding the budget proposal to the municipality? How has the request been processed?

    The deadline for responding has been extended until May 2, 2025.

    § 81 Closing of municipal offices due to annual holidays 2025

    The municipal office has been closed for three or four weeks each year in July, when the entire staff has been on annual leave. Partial centralization of leave can ensure more efficient services at other times. No annual leave substitutes have been used at the municipal office.

    The majority of staff have 38 working days of annual leave. In 2025, the municipal office could be closed for four weeks in July. In addition, it has been requested that annual leave be allocated to public holidays, in which case a complete closure would also be appropriate due to reduced staff resources.

    § 85 Real estate transfer notifications

    According to Section 1 of the Pre-emption Act (5.8.1977/608), a municipality has a right of pre-emption in the sale of real estate located in the municipality in order to acquire land for community development and for recreational and conservation purposes. The right of pre-emption means the municipality's right to redeem the sold real estate for the purchase price agreed upon by the seller and the buyer. When using the pre-emption, the municipality takes the place of the buyer and acquires ownership of the area that is the subject of the sale under the terms of the deed of sale.

    The municipality must also compensate the buyer for direct costs related to the transaction and pay interest on the costs in accordance with Section 3, Subsection 2 of the Interest Act (633/1982). According to Section 21 of the Pre-emption Act, the city government decides on the exercise of the pre-emption right. The decision must be made and the registration authority, i.e. the Land Survey, notified of it within three months of the certification of the transfer deed.

    The decision must be given without delay as a demonstrable notification to the buyer and seller.

    § 87 Filling the position of Technical Director, election

    The municipal government decided at its meeting on April 2, 2025, § 73 to extend the application period for the position of technical director until April 22, 2025. Previous applicants will be considered.

    The following submitted applications by the deadline:

    According to Section 50 of the Municipal Administrative Regulations, "the municipal government shall decide ... on the selection of the technical director."

    According to Section 125 of the Constitution, the general criteria for appointment to public office are skill, ability and proven civic virtue. When filling a position, the provisions of the Equality Act and the prohibition of discrimination in Section 12 of the Act on the Security of Employment of Municipal Officials Act are taken into account.

    According to Section 7 of the Act on Municipal Officials (304/2003), the appointment is conditional until the person selected has presented an approved certificate of health to the employer. A six (6) month probationary period is used for appointment.

    Proposal for a decision

    The municipal board decides to elect Reijo Väliharju, M.Sc. in Civil Engineering, to the position of Technical Director of the Municipality of Kihniö.

    Of the applicants, Reijo Väliharju has been found to have the best qualifications to successfully perform the official duties. The decision is based on an overall assessment that takes into account eligibility criteria, education, work experience, interview and general criteria for appointment of civil servants.

    When filling a position, the provisions of the Equality Act and the prohibition of discrimination in Section 12 of the Act on Employment Security for Municipal Officials Act, as well as the general appointment criteria for public positions laid down in the Constitution, are taken into account.

    The election to the office is conditional until the person elected has presented an acceptable certificate of health no later than 30 days after being informed of the election decision. The office is subject to a probationary period of six (6) months.
