§ 211 Legality and quorum of the meeting
Proposal for a decision

The legality and quorum of the meeting are established. The participants in the meeting are noted.

Decision

The meeting was declared legal and quorate. The participants were noted. The meeting was called as an emergency meeting with the consent of the members of the institution due to the urgency of the matter (Administrative Rules § 140).

§ 212 Selection of the minutes inspectors
Proposal for a decision

Two minutes reviewers will be elected. The minutes will be reviewed on December 13, 2024 and will be available for viewing on December 13, 2024 on the municipal information network.

Decision

The motion for a resolution was adopted unanimously.

Janne Ojala and Marjo Niemi were elected as the minutes reviewers.

§ 213 Termination of employment / mayor

In accordance with Section 42 of the Local Government Act, the municipality and the mayor must enter into a manager's agreement, which sets out the conditions for managing the municipality. The manager's agreement is approved by the municipal board. The manager's agreement may include provisions on the division of labour between the mayor and the chairman of the municipal board in managing the municipality, taking into account what is provided in the administrative regulations. The manager's agreement may include provisions on the procedures by which disagreements related to the performance of the mayor's office are resolved instead of the procedure referred to in Section 43. In such cases, the manager's agreement may include an agreement on severance pay to the mayor, which is compensation for the mayor's weaker protection against dismissal than other municipal office holders.

In accordance with Section 43 of the Local Government Act, the council may dismiss the mayor or transfer him to other duties if he has lost the council's confidence. The matter is initiated upon a proposal from the municipal board or upon a motion by at least a quarter of the councillors. When preparing the matter, the mayor must be informed of the basis for the loss of confidence and be given an opportunity to be heard. An alternative to the council's dismissal of the mayor based on loss of confidence is to implement the dismissal by agreement.

The presidium of the Kihniö Municipal Council and the Municipal Board and the Mayor held negotiations on 5 December 2024. After considering the matter, the Mayor has decided to voluntarily resign based on Section 42 of the Local Government Act. The parties have jointly negotiated an agreement on the termination of the Mayor's employment relationship.

The mayor has resigned from his position in accordance with Section 42 of the Local Government Act and the employment termination agreement, so that the employment relationship will end on December 12, 2024 without notice.

A separate agreement has been drawn up regarding the termination of employment (attached material).


Proposal for a decision

Rapporteur: Chairman of the Municipal Board

The municipal government decides:

1. that the matter will be discussed on the basis of the chairman's report without a presentation by the office-holder and that the chairman's proposal will form the basis of the discussion and does not require support

2. that the agreement drawn up on the municipal mayor's employment relationship is approved and the municipal mayor's employment relationship is terminated. The municipal mayor is granted a resignation in accordance with his request, so that the employment relationship ends on 12 December 2024.

3. forward the information about the termination of the employment relationship to the council for its information.
