Section 90 of the Local Government Act provides for the administrative regulations of a municipality. The act has been updated regarding the activities of a municipality in exceptional circumstances and disruptions. Municipalities must bring their administrative regulations into line with the revised Section 90 of the Local Government Act by the end of September 2023.
In addition, due to organizational changes (welfare area), the municipality of Kihniö needs to update certain parts of the administrative regulations. The most important change to the administrative regulations is the name and duties of the Education Committee, the title of the Director of Education and its jurisdiction have been updated. In addition, several minor clarifications have been made.
The amendments to the current administrative regulations are presented in the attached appendix. Additions are marked in red, deletions are crossed out.

The municipal board decides to propose to the municipal council the approval of the administrative regulations in Appendix 14. The changes to the administrative regulations will enter into force after the decision is approved.

Municipal council
According to Section 110 of the Local Government Act (10 April 2015/410), the council must approve the municipality's budget for the following calendar year by the end of the year, taking into account the financial responsibilities and obligations of the municipal group. In connection with its approval, the council must also approve a financial plan for three or more years (planning period).
The budget year is the first year of the financial plan. The budget and plan must be prepared in such a way that they implement the municipal strategy and ensure the conditions for performing the municipal tasks. The budget and plan approve the operational and financial objectives of the municipality and the municipal group.
The financial plan must be balanced or in surplus. The deficit accumulated in the municipality's balance sheet must be covered within a maximum of four years from the beginning of the year following the approval of the financial statements. The municipality's financial plan must decide on specific measures to cover the deficit during the specified period.
The budget includes the appropriations and revenue estimates required for the tasks and operational objectives, and indicates how the financial need will be covered. The appropriation and revenue estimate can be taken as gross or net amounts. The budget includes a profit and loss account section, as well as an investment and financing section.
The municipality's operations and finances must comply with the budget. Any changes to it are decided by the council.

In its 2022 evaluation report, the Kihniö Municipality Audit Board requests the municipal government to provide the council with a statement based on Section 121.5 of the Municipalities Act on the measures that the evaluation report gives rise to.
The administrative authorities are requested to provide their opinion on the following matters:
- Municipal board:The Audit Board considers it important that the municipality of Kihniö actively seeks a fair settlement for the disputed social welfare expenses.
- Education Committee: The Audit Committee considers it important that workplace well-being surveys are conducted systematically and that their results are utilized in the development and management of operations.
- Technical Committee:One ongoing goal is to update the classification of real estate assets. The Audit Board considers it important that the work related to the real estate portfolio is utilized as best as possible in the management of the properties.

In its 2022 evaluation report, the Kihniö Municipality Audit Board requests the municipal government to provide the council with a statement based on Section 121.5 of the Municipalities Act on the measures that the evaluation report gives rise to.
Real estate portfolio and real estate strategy
Regarding the technical committee, the audit committee has paid attention to the update of the classification of real estate assets. The audit committee considers it important that the work related to the real estate asset portfolio is utilized as well as possible in the management of the properties. The audit committee has also continued to pay attention to the significant repair debt of the properties owned by the municipality. The audit committee considers it important that the reduction of the repair debt is carried out systematically and in accordance with the guidelines of the real estate strategy. The audit committee also emphasizes the importance of appropriate reporting related to the implementation of the real estate strategy and the reduction of the repair debt.
The municipality of Kihniö has prepared a property portfolio, in which the properties are divided into those to be maintained, those to be developed and those to be transferred. The property classification has been made at a general level, based on satisfying the need for space in terms of service production and the condition of the properties.
The Technical Committee states that the property portfolio as such does not serve and guide property management and has decided to update the municipality's property and premises strategy 2024 - 2028. Under the guidance of the Technical Committee, the basic information phase of the strategy preparation is underway and is being carried out as an official task. In the strategy, the property classification is updated as necessary based on the actual use needs of the properties (current and forecast), quality requirements, condition classification, repair debt and financial situation. The property strategy will also include an action plan with its cost implications.
The stages and schedule for developing the strategy are as follows:

The updated strategy is considered to best serve and guide operational activities.
Quality control of technical services
The Audit Committee has also stated, based on the information it has received, that in technical services, efforts have been made to include the turnaround times for fault reports and service requests as part of quality control. According to the Audit Committee, monitoring turnaround times is a good example of measuring the quality of operations and it considered it important that quality measurement be further developed.
Technical service requests can be made via the electronic maintenance book (internal tenants), by email or by telephone. The Technical Committee will consider monitoring the turnaround time of service requests as part of the municipal strategy's dashboard and will develop and specify operational management and information related to notification channels.
Leadership development
The Audit Committee further notes that measures related to management development have been taken in the technical action and notes that measuring quality is part of the management development work. The Audit Committee encourages the continuation of management development work.
The technical task has launched an organization and operating model study of the service production of technical services in August 2023. The study will investigate the current situation, analyze and compare the organization and service production models and cost structures of the reference municipalities in relation to the situation and needs of Kihniö, and analyze and compare alternative ways of producing services: VE1 streamlining/developing current production, VE2 outsourcing and VE3 hybrid. In the investigation of the current situation, the definition of the service level is emphasized, the clarification of which will also guide the management of the technical task - regardless of the form of service that the services will be produced in the future.
Municipal board notes that negotiations with the City of Parkano regarding social and health care spending are continuing.
The municipal government shall provide the audit committee and the municipal council with a statement on the measures that the evaluation report provides grounds for.

Statement of the municipal leaders of small municipalities in Pirkanmaa on the service network study of the Pirkanmaa welfare area and the target state presented therein
The municipalities of Pirkanmaa and the welfare region signed a cooperation agreement in the winter. According to the agreement: “The strategic partnership is built on strong trust and commitment to working together. Cooperation is carried out in open and interactive relations.” The agreement also states: “The goal is to optimize and synchronize the implementation programs of the municipality and the welfare region with each other, as well as to inform and consult the management of the municipalities and the welfare region in the development of the social welfare and rescue services service network and the implementation of the land use and service network of the municipalities in the region.” Now we, the municipalities, expect this partnership, trust, and consultation from the welfare region.
Several municipalities in Pirkanmaa have read with great concern the change plan presented in the Pirkanmaa welfare area service network study, according to which the current network of 40 brick-and-mortar locations is being reduced to 21 locations, seven (7) of which are located in Tampere. According to the proposal, a total of eight (8) municipalities in Pirkanmaa would be left without their own physical health center, which are Ikaalinen, Juupajoki, Kihniö, Punkalaidun, Pälkäne, Ruovesi, Urjala and Vesilahti. Inpatient wards are also being closed in Kuhmoi, Ikaalinen, Mänttä-Vilppula, Orivesi and Ruovesi.
Such a radical plan is justified primarily by euros and the population numbers in the areas in question. Both justifications have their challenges. The problem with euros is that there is still no precise plan for what the health services that will replace brick-and-mortar locations will be. There is talk of mobile and digital services, but there is no concrete information on how and where these would be available. There is no cost comparison of what mobile and digital services cost compared to continuing to have a clear physical service in a brick-and-mortar location. It is not yet known what the transition to mobile and digital will cost and whether the necessary technology and equipment is available.
Pirha doctors Elina Miettola and Riikka Hämeenoja commented on the report in their own opinion piece in Aamulehti on 22 August 2023. According to them, the older and sicker the population, the greater the need for face-to-face encounters and patient examinations. They also point out that a large proportion of patients are unable to do business electronically and that patients who are otherwise in better health usually do business electronically. Pirha's report refers to the morbidity index. In Pirkanmaa, it is highest in Ruovesi (136) and third highest in Kihniö (131). These municipalities therefore have the sickest population in Pirkanmaa, who probably need that local service more. Yet, brick-and-mortar clinics are being closed in these municipalities. Six other municipalities where walk-in clinics are being discontinued also have a reasonably high morbidity rate: Urjala 128, Ikaalinen 116, Pälkäne 113, Juupajoki 110 and Punkalaidun 107. This also correlates very much with the elderly population, which is relatively higher in these municipalities than in municipalities with a low morbidity index. Cross-tabulating all these factors could lead to an analysis that better describes reality. By removing walk-in clinics from these small municipalities, this oldest and most unwell population is forced to travel the longest distances to walk-in clinics, which they probably need more than the rest of the population. Therefore, it is unreasonable to look at the number of clinics in relation to the number of inhabitants, because the figure is not comparable in terms of the geography of the municipalities and the morbidity of the inhabitants.
Both of these above perspectives are also strongly linked to an impact assessment, which is regrettably lacking in the report. Not only is there a lack of a clear cost comparison, there is also a lack of an assessment of how digital services and mobile services can actually meet the service needs resulting from the discontinuation of brick-and-mortar services and what their effectiveness is as substitutes for local services. Is there also a risk that the lack of regular local services could lead to people seeking treatment too late and thus increasingly burden more expensive specialized medical care? Is there also a risk that the overall well-being and loneliness of these less populated areas and those living further away from service centers will increase, and thus inequality among people will increase, and equality in Pirkanmaa will not be achieved?
Reducing the number of reception service points is a very significant decision from the perspective of the residents of the municipality and the entire municipality, and the effects of which should be assessed on a municipality-by-municipality basis. It is a different matter to close one of the municipality's branch points than the municipality's only service point. Although the study looks beyond municipal borders, a lot of people's transactions take place within their own municipality. In small municipalities, the city center areas where the points are located are usually very compact and form an ideal living environment for the elderly population, where the health center, pharmacy and grocery store are all located close together and bring ease, smoothness and safety to life. The decisions to close Pirha also threaten other municipal services, as people will have to travel further afield for health services anyway. Pirha is taking on an unnecessarily large role in determining the future vitality of small municipalities.
We all understand that the way services are organised is changing and needs to change. It is important that the digital opportunities of the future are utilised as well as possible. However, it does not seem to be equal for the municipalities in Pirkanmaa, that in some areas the service network is very dense and in other areas the brick-and-mortar service is being moved further and further away from the customer and digital and mobile services are being proposed as a replacement, which should above all be complementary services to the brick-and-mortar service. The condition assessments made of the municipalities' health centres are inadequate and do not directly describe the real situation. Instead of maintaining small health centres, significant additional investments have to be made in larger health centres. In this respect, it is also questionable whether the financial burden is smaller or greater when centralising them in larger units.
We, the mayors of the small municipalities in Pirkanmaa, hope that the Pirkanmaa welfare region will not make hasty decisions about the social and health service network before the alternative operating models can be truly assessed in terms of both costs and effectiveness. Pirkanmaa is a rich region due to its diversity. Around the strong central city and surrounding municipalities, there is a diverse and strong group of municipalities, some of which have profiled themselves as, for example, significant agricultural and/or tourism areas, which bring diverse attraction and vitality to Pirkanmaa. We hope that this will continue to be the case.
The municipal government takes note of the above-mentioned statement by the small municipalities of Pirkanmaa, which has been submitted to the Pirkanmaa Wellness Area and the media.
In addition, the Municipal Board separately demands that the municipalities, which are the guardians of the interests of the residents, be included in the preparation of the service network study for the Pirkanmaa welfare area. And both the municipalities and the residents will be officially consulted in such a way that the consultation has actual impact.
The municipality of Kihniö is ready to negotiate a reduction in property rental costs in order to maintain services.
The municipal government emphasizes that Kihniö's locations are classified in the second highest condition category.

Tuomi Logistiikka Oy is a company owned by the City of Tampere (44,11%), the Pirkanmaa Welfare Region (42,05%), the Kanta-Häme Welfare Region (11,09%) and individual municipalities (approximately 1,84%). Its business is to manage procurement services, material supply, transport control or other similar logistical services and to promote, develop and implement related activities. The company operates as a joint procurement unit that directly or indirectly purchases goods or services from the purchasing units that own it, or concludes procurement contracts or framework agreements for these goods, services or construction contracts.
The company operates as an affiliated unit (in-house status) in relation to the owners in accordance with the Procurement Act (29.12.2016/1397).
The number of shares held by small shareholders varies between 300 and 1000. The share price is 6,95.
Tuomi Logistiikka tenders procurements on behalf of its partners and charges a commission fee based on the products ordered. Participating in joint procurement is free of charge, and the costs of the tender are covered by the commission fee for products sold under the agreement or the margin on stock products. This means that you only pay for the procurement as much as you order products or services. Our commission rate usually varies between 2-3 percent, depending on the estimated total value of the procurement.
Commitment to procurement does not only mean commitment to the competitive bidding process, but also the implementation of procurements based on the competitive bidding. By committing to procurement, your organization commits to making purchases for the product or service in question from the selected contracting partners.
The municipality of Kihniö procures occupational health services under a contract from Pihlajalinna Lääkärikeskukset Oy. The contract is valid until further notice. The occupational health care reception was moved to Parkano in spring 2023.
Tuomi Logistics is starting a joint procurement process for competitively bidding for occupational health services. According to Tuomi Logistics:
"The purpose of the joint procurement is to put out to tender a wide range of occupational health services that meet the needs of customers. The procurement includes at least statutory preventive occupational health care, general practitioner-level medical care and other necessary healthcare services. The procurement takes into account regional local reception needs and remote reception possibilities. The aim of the procurement is to achieve high-quality occupational health services at competitive prices and contract terms and to utilize the larger than usual procurement volume resulting from the joint procurement."
The tendering process could begin in autumn 2023, if the municipality of Kihniö is approved as a shareholder of Tuomi Logistics. The contract period could begin in spring 2024, but it could also be extended later.

- to approve the shareholder agreement of Tuomi Logistiikka Oy and request Tuomi Logistiikka to accept the municipality of Kihniö as a shareholder with 300 shares.

According to Section 110(5) of the Local Government Act, the municipality's operations and financial management must comply with the budget. Any changes to it are decided by the council.
In connection with the interim report, the Technical Committee has reviewed the implementation of investments and made proposals for changes to the budget. Some of the investments will not be implemented this year and some sites have had to undergo necessary repairs that exceed the investment limit. Changes are proposed in these respects. The budget allocated for investments will not be exceeded.
The support for the Pyhäniemi development project, EUR 33.215, has been paid this year. It will be added as investment income.

According to Section 1 of the Pre-emption Act (5.8.1977/608), a municipality has a right of pre-emption in the sale of real estate located in the municipality in order to acquire land for community development and for recreational and conservation purposes. The right of pre-emption means the municipality's right to redeem the sold real estate for the purchase price agreed upon by the seller and the buyer. When using the pre-emption, the municipality takes the place of the buyer and acquires ownership of the area that is the subject of the sale under the terms of the deed of sale.
The municipality must also compensate the buyer for direct costs related to the transaction and pay interest on the costs in accordance with Section 3, Subsection 2 of the Interest Act (633/1982). According to Section 21 of the Pre-emption Act, the city government decides on the exercise of the pre-emption right. The decision must be made and the registration authority, i.e. the Land Survey, notified of it within three months of the certification of the transfer deed.
The decision must be given without delay as a demonstrable notification to the buyer and seller.
